Chapter I General Provisions
Article 1 In order to ensure the long-term educational development of international students, maintain the normal order of the university, and to create a good learning and living environment, the following regulations are formulated in accordance with the Administrative Measures for International Student Enrollment and Education (Order No. 42 jointly distributed by Ministry of Education, Ministry of Foreign Affairs and Ministry of Public Security ), with reference to Regulations on Disciplinary Actions of Students of China Pharmaceutical University (Trial), and with concerns about the actual situation of the administration of international students.
Article 2 These regulations apply to students of foreign nationalities at all levels studying at China Pharmaceutical University (hereinafter referred to as international students). The disciplinary action against non-degree international students shall be implemented in accordance with these regulations. Those with serious violations shall be ordered to terminate their studies and leave the university.
Article 3 The purpose for executing disciplinary actions shall be educational and preventive. Punishments shall be in accordance with the severity of violations, on the basis of sufficient evidence, clearly defined provisions, accurate determination, proper procedure, and appropriate action.
Chapter II Types and Applications of Disciplinary Action
Article 4 International students who violate laws, regulations, rules and disciplines shall be given disciplinary action in accordance with these regulations. The types of disciplinary action, from minor to major, are as follows:
(1) Warning;
(2) Serious warning;
(3) Demerit record;
(4) Academic probation;
(5) Expulsion.
For punishments less than warning, the School of International Education shall give a notice of criticism in public and urge the student to correct mistakes.
Article 5 Other than expulsion, a disciplinary action period shall be set. Starting from the day when the disciplinary decision is made, the period of warning and serious warning shall be 6 months. The period of demerit record and academic probation shall be 12 months. The disciplinary period for final-year students may be reduced to the graduation day (end date).
Article 6 The period for Academic probation shall be 12 months, and the inspection period shall be the same as the period of punishment. The international students who are subject to the probation shall be inspected by their academic school or department. For the final-year international students who are subject to disciplinary action, the period may be reduced to date of graduation or completion of program.
Article 7 Before a disciplinary decision is made, if the international student has violated more than two disciplines, the corresponding disciplinary actions shall be made separately. If on the same level, the same punishments shall be taken; if on different levels, the most severe punishment shall be taken.
Article 8 A lenient punishment shall be imposed one of the following conditions:
(1) A violation of discipline has occurred, but the international student voluntarily admits mistakes before the university discovers, and there is obvious repentance;
(2) International student takes measures on their own initiative to effectively avoid or recover losses or eliminate the effects;
(3) Reporting an approved major violation of discipline of others;
(4) Being coerced or deceived by others;
(5) Other situations that the university authorities believe can be taken lightly.
Article 9 A heavier punishment shall be imposed under the following conditions:
(1) Covering up and concealing the facts of disciplinary violations and refusing to admit mistakes;
(2) Violations of discipline have caused serious consequences or adverse effects;
(3) Framing, deceiving, threatening or retaliating against relevant personnel;
(4) Being a group violation organizer;
(5) Other circumstances that university authorities believe can be severely punished.
Article 10 International students who have been punished during their study period shall have their punishment levels accumulated if punished again.
Article 11 International students who have been punished shall be disqualified from relevant scholarships and various honorary titles within one year.
Chapter III Disciplinary Violations and Punishments
Article 12 If an international student has one of the following acts, he/she shall be expelled:
(1) Violating the Chinese Constitution or opposing the Four Basic Principles, undermining stability and unity, and disrupting social order;
(2) Committing a crime, according to the Criminal Law of the People's Republic of China;
(3) Receiving serious administrative penalty from the police, or being repatriated by Public Security Office;
(4) Taking exams for other people or allowing others to take the test for him/her, organizing cheating, using communication equipment or other equipment to cheat, selling test questions or answers to others for profit, and other actions of serious cheating or disturbing the test order;
(5) Academic misconducts such as plagiarism, falsification, and forgery in research article, dissertation and published research results, writing articles/papers/dissertations for other people or allowing others to write articles/papers/dissertations for him/her, buying or selling articles;
(6) Seriously affecting the university’s education and teaching order, life order, and public space management order;
(7) Infringing on the legitimate rights and interests of other individuals and organizations, causing serious consequences;
(8) Prostitution, whoring, introducing or sheltering prostitution or whoring, possession of drugs, drug abuse, drug trafficking;
(9) Repeated violations of disciplines, and fail to improve after disciplinary actions.
Article 13 If an international student receives administrative penalty from the police, but does not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from serious warning to academic probation.
(1) Those who violate laws and regulations and are sentenced to administrative detention shall be given academic probation or above;
(2) Those who violate laws and regulations and are warned or fined shall be given serious warning.
Article 14 If an international student commits any of the following acts that undermine the friendship between China and foreign countries and the harmony of the campus but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from warning to academic probation.
(1) Being unfriendly to China, not respecting Chinese culture, having anti-China statements and deeds that insult China which cause adverse effects or consequences, disciplinary actions shall be given from serious warning to academic probation;
(2) Not respecting other people's culture, religion, customs and national system, causing adverse consequences, disciplinary actions shall be given from warning to academic probation;
(3) Having other improper words and deeds, causing adverse consequences.
Article 15 If an international student commits any of the following acts that disturb the campus order but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from warning to academic probation.
(1) Disturbing classroom teaching order, trying to pick a quarrel with the teacher or other administrative staff and making trouble out of nothing: from serious warning to academic probation;
(2) Being improper in words and deeds when communicating with people of the opposite sex; those who have excessive behaviour and refuse to accept dissuasion: from warning to academic probation according to the seriousness;
(3) Molesting, insulting females or committing other sexual harassment acts: academic probation to above according to the seriousness;
(4) Excessive drinking, making troubles, or gang fighting in canteen, dormitory or other public places which disturb the campus order: from warning to academic probation;
(5) Organizing religious activities, disciplinary actions: from demerit record to academic probation; those who refuse to improve after dissuasion shall be expelled;
(6) Distorting or fabricating facts, spreading rumors through words, letters, telephone calls, mobile phones, the Internet, etc.: warning to academic probation;
(7) Obstructing official duties of university administrators or national officials, without listening to dissuasion: warning to academic probation;
(8) Other acts that disturb the order of the campus, warning or above;
Article 16 If an international student has one of the following acts that endangers public safety on campus, but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from warning to academic probation.
(1) Illegally storing controlled knives;
(2) Illegal use of fire indoors or near flammables, storing/use of prohibited electric stoves, heaters, electric blankets, electric cups, rice cookers and other electric heating appliances and high-power appliances, and failing to correct after dissuasion.
(3) Deliberately throwing objects, fires, etc. outside dormitories or classrooms, endangering the public safety;
(4) Deliberately moving, arbitrarily opening or destroying security facilities and traffic signs other than for emergency;
(5) Violating the campus traffic regulations and causing adverse effects and infringement of others’ legal rights;
(6) Violating lab regulations by bringing dangerous substances such as flammable, explosive, toxic or corrosive substances out of the laboratory or storing these substances out of designated storage places, causing serious safety hazards; illegally carrying dangerous goods and chemical reagents into public places such as classrooms, dormitories halls, canteens and conference halls;
(7) Other acts that endanger public safety of the campus.
Article 17 If an international student has one of the following acts that disturb public order on-campus, but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from warning to academic probation.
(1) Violating the relevant management regulations by holding lectures, reports, forums, etc., without approval;
(2) Violating the regulations on the management of student associations, organizing student associations without approval, or using the name of legitimate student associations to carry out activities, publishing illegal books or journals, etc.;
(3) Violating the Internet use regulations of China and CPU, visiting illegal websites, or transmitting harmful information;
(4) Hacking/Attacking the university information system, stealing or tampering with, or causing damage to system functions, applications, and data;
(5) Engaging in for-profit business, advertising and other activities on-campus without approval;
(6) Smoking in violation of regulations in public places and indoors;
(7) Other acts that hinder the university's management order.
Article 18 If an international student has one of the following acts that infringe on public or private property, but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act:
(1) Deliberately damaging university facilities, educational equipment, furniture, electric appliances, trees, lawns and other items: warning or above;
(2) Scribbling on buildings or public facilities, posting without approval: warning or above;
(3) Damaging books from the library, or use other's IDs to borrow books: warning or above;
(4) Taking possession of public property or other’s personal belongings, if the value is less than 1,000 Yuan, warning shall be given; if the value is more than 1,000 Yuan but does not constitute a crime, a serious warning or above shall be given.
(5) Buying, selling, damaging or storing a stolen good, which do not constitute a criminal offense: warning or above;
(6) Those involved in campus economic fraud, illegal organization, and participation in campus usury or pyramid sale, which have not constituted a crime: warning or above.
(7) Other acts of infringement of public and private property: warning or above.
Article 19 If an international student has one of the following acts that infringe on the personal rights of others, but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act.
(1) If a student provokes or involved in a physical assault that does not cause personal injury, warning shall be given; if caused personal injury: serious warning or above;
(2) Insulting others or fabricating facts to infame others: warning or above;
(3) Concealing, destroying or opening letter, postal packet, etc. of others: warning or above;
(4) Using letters, telephones, text messages, e-mails, online messages, etc. to threaten the safety of others and interfere with the normal life of others: warning or above;
(5) Harassing others, affecting the normal life and study of others, shall be given warning; if the circumstances are serious: serious warning or above;
(6) Other acts that infringe upon the personal rights of others: warning or above;
Article 20 If an international student has one of the following acts that violate residency regulations on-campus, but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from warning to above.
(1) Illegal adaptation of circuit of the dormitory or charging electric appliances outside from an indoor socket outlet;
(2) Making loud noises, playing music/musical instruments, or using audio-visual equipment, etc.,during the stipulated bed time, in the dormitory area and the student activity room, disturbing others and refusing to stop after dissuasion;
(3) Hosting visitor overnight, exchanging, occupying or subleasing dormitory room/bed without official approval;
(4) Staying off-campus overnight or renting apartment without official approval;
(5) Hosting visitor or staying in a dormitory of others;
(6) Keeping pets in dormitory or bringing pets into the dormitory yard, and refusing to correct after dissuasion;
(7) Deliberately or advertently making the dormitory dirty and messy, and fails to correct after dissuasion;
(8) Other acts that violate the regulations of university dorms.
Article 21 If an international student has one of the following violations of laboratory management regulations but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act.
(1) If the equipment is damaged or lost due to illegal operation: warning or above.
(2) Those who illegally purchase, collect, use or preserve poisons, narcotics, precursors, explosives or other dangerous chemicals: demerit record or above.
(3) Those who illegally purchase, rent, use or store pressure vessels, gas containers and other special equipment: demerit record or above.
(4) Those who illegally raise, manage, quarantine, use or dispose experimental animals: demerit record or above.
(5) If the laboratory waste is not collected according to the specifications or the laboratory waste is poured into the sewer or mixed into domestic garbage: demerit record or above.
(6) Those who arbitrarily deactivate or destroy the environmental protection treatment facilities for waste gas and wastewater: demerit record or above.
(7) In case of fire or fire accident caused by fire, electricity or improper experimental operation: demerit record or above.
(8) Other acts that violate the regulations of the laboratory management after reminder: warning or above.
Article 22 If an international student has one of the following discredit acts but do not yet meet the standard for expulsion, disciplinary action shall be taken according to the seriousness of the act, from warning to academic probation.
(1) If student knows that another person is in violation of discipline and obstructs the university or law enforcement agency from investigating, or tells lies when being investigated, shall be given warning;
(2) Falsifying in the application of university scholarships or awards, governmental scholarships or awards, allowances or subsidies, medical insurance reimbursements, etc., in addition to returning the illegal income: demerit record or above;
(3) If there is no justifiable reason for the late payment of tuition fees, accommodation fees, etc., if the circumstances are serious: warning or above;
(4) Forging identity cards, official stamps, altering or forging student ID cards documents, personal seals, signatures of others, altering or forging transcripts, certificates, etc. : demerit record or above;
(5) If there are other acts of dishonesty, depending on the circumstances: warning or above;
Article 23 If an international student leaves the campus without authorization or is absent from the university’s routine teaching activities and do not yet meet the standard for expulsion, the disciplinary action shall be taken according to the nature of the disciplinary act and the seriousness:
(1) If consecutively more than 2 days, less than 4 days, or accumulatively more than 4 days in a semester and less than 8 days, warning shall be given;
(2) If consecutively more than 4 days, less than 6 days, or accumulatively more than 8 days in a semester and less than 12 days, serious warnings shall be given;
(3) If consecutively more than 6 days, less than 8 days, or accumulatively more than 12 days in a semester, and less than 16 days, demerit record shall be given;
(4) If consecutively more than 8 days, less than two weeks, or accumulatively more than 16 days in a semester, less than four weeks, academic probation shall be given.
Article 24 If an international student violates the discipline of the examination site or cheats in the examination, disciplinary action shall be given according to the nature of the disciplinary act and the seriousness of the fault:
(1) The following acts shall be deemed as “minor violation of exam rules”, the minimum punishment is warning, the test score will recorded as zero, and student shall not participate in the normal retest:
1. Before the test paper is issued, student hasn’t put bags, books, notebooks, etc. in the designated place of the examination room as notified by the invigilator;
2. Communication devices such as mobile phone is not turned off and placed in the designated place of the examination room;
3. During the examination process, not sitting in accordance with the seat arranged by the invigilator;
4. During the examination process, peeping, whispering or gesturing once again after a warning;
5. Bringing test papers, answer sheets and draft papers out of the examination room without permission;
6. Refusing to follow the management of the invigilator;
7. When the time is up, talking to others before the test papers and answer sheets are handed in.
8. Other violations of the rules of the examination room.
(2) The following acts are deemed as cheating, the minimum punishment is academic probation, the score shall be recorded as zero, and student shall not participate in the normal retest:
1. Hiding test-related materials under the test paper, in pencil box, in the desk, or under clothes;
2. Writing test-related contents on the desktop, walls, body, etc.;
3. Leaving the examination room to peek at the test-related contents;
4. Peeking or copying books, relevant materials, paper notes or other’s test papers;
5. Exchanging or taking other people's papers, draft papers or answer sheets;
6. Using electronic devices with storage functions or communication devices such as mobile phone, tablet or laptop computers to access the Internet or view pre-stored content related to the test;
7. In open-book exams, using other people's exam course materials or using materials other than those specified in the exam, in computer-based test, connecting to the Internet without permission or copying other people's materials.
8. Collaborative cheating behaviors such as passing notes, indicating, providing or checking answers with others, exchanging test papers, or do not report to invigilator when test paper is taken by other people;
9. During the grading process, if the graders discover two or above suspiciously similar answers, student will be investigated as cheating;
10. Other acts deemed as cheating in the exam.
(3) The following acts are deemed as “serious cheating”, and expulsion is given:
1. Taking exam for others or letting others take his/her test;
2. Organizing cheating;
3. Using communication equipment or other equipment to send or receive information;
4. Selling test questions or answers to others for profit;
5. Other acts identified as serious cheating.
Article 25 Plagiarism or other academic misconducts shall be dealt with in accordance with the relevant provisions of academic misconduct.
Article 26 If a student organizes, incites or participates in illegal gathering, strike or demonstration, and do not yet meet the standard for expulsion: warning or above.
Article 27 If a student participates in pyramid sales or engages in cult or superstitious activities and do not yet meet the standard for expulsion: warning or above.
Article 28 If a student engages in or participates in activities that are detrimental to the image of university or against Chinese social ethics, and do not yet meet the standard for expulsion: warning or above.
Article 29: Participating in gambling or providing convenience for gambling, as well as reading, watching, posting, distributing, producing, copying or selling illegal books, articles, audio, video, etc., and do not yet meet the standard for expulsion: serious warning or above.
Chapter IV Procedures
Article 30 For disciplinary action and dismissal of international students, all schools, departments and offices shall perform their duties and coordinate their work. Disciplinary decision for warning and serious warning shall be made by the School of International Education and reported to the Student Affairs Office (undergraduate) or Graduate School to put on record; Disciplinary decision for demerit record and academic probation shall be made by the Disciplinary Committee of the University; Expulsion shall be brought to the president’s meeting for final decision. The dismissal of a disciplinary action shall be made by the same school/department/office, respectively.
Article 31 The general procedure of a disciplinary action:
1. investigation and evidence collection, 2. proposing a disciplinary action, 3. discussion and decision 4. delivery.
(1) Investigation and evidence collection. For warnings and serious warnings, the school/department sees to the investigation and evidence collection. For demerit record and above, relevant administrative office sees to the investigation and evidence collection. The facts of violation of discipline shall be clearly defined and the evidence shall be sufficient.
(2) Proposing for disciplinary action. The suggestions of disciplinary action shall be made by School of International Education based on the investigation result and evidence collection. The School informs the international student of the facts, reasons and basis for disciplinary actions, and the student has the right to report and defend.
(3) Discussion and decision. Warnings and serious warnings shall be promptly submitted to the Dean’s Office of the School for discussion and decision, and shall be reported to the Student Affairs Office or Graduate Office for record; Demerit record and above shall be promptly submitted to the Disciplinary Committee of the University by School of International Education; expulsion shall be submitted to president’s meeting by School of International Education.
(4) Delivery. The disciplinary decision letter shall be delivered promptly by the School to the international student. If the student refuses to sign, the letter shall be delivered to student’s residence and deemed as “received”; if student is outside campus, the letter will be delivered by post; if it is difficult to contact, the letter will be posted on the school website, news media, etc. The announcement period is 60 days, starting from the date of publication.
Article 32 A disciplinary decision letter should contain the following:
(1) Personal information of the international student;
(2) The facts and evidence of violation;
(3) The type, basis and time limit of the punishment;
(4) Methods and deadlines for defense;
(5) Other necessary contents.
Article 33 If an international student disagrees with the disciplinary decision, within 10 days from the date of receiving the disciplinary decision, the student may file a written appeal with the university student appeal handling committee, in accordance with its relevant provisions.
Article 34 International students who have been expelled shall go through the university leaving formalities and procedures for renewal of stay visa within two weeks from the date of receipt of the decision letter; if they refuse to leave within the time limit, School of International Education shall enforce the leaving formalities and reporting to the entry and exit administration department for compulsory cancellation of the student’s visa in China. When leaving, School of International Education issues a study certificate that includes the truthful facts.
Article 35 School of International Education shall inform international students’ embassies and consulates in China of the violation of discipline by the students. If they are scholarship students of various levels of Chinese government, they shall also be reported to the relevant departments of the Chinese government.
Article 36 The general procedure for dismissal of disciplinary action.
(1) Submit an application. Within 15 days prior to the expiration of the disposition period, the international student must submit a written application to his/her school/department to dismiss the disciplinary action.
(2) Discussion and decisions. Within 10 days after receiving the application for dismissal of warning and serious warning action, School of International Education shall hold a meeting to discuss the decision on dismissal, and report to the Student Affairs Office or Graduate Office for the record. After receiving the application for dismissal of demerit record or academic probation action, the school or department shall report the university disciplinary action group to discuss the decision on dismissal. The letter of dismissal decision shall be delivered to student by School of International Education.
Article 37 International students who receive academic probation are subject to the inspection. When the inspection period is over and student has no violation of discipline, he/she may apply directly for dismissal of punishment. After the decision is made, the inspection period shall be finished.
Article 38 The decision on the disciplinary decision or the dismissal shall take effect from the date of issuance. All paper documents of disciplinary action and dismissal shall be completely included in the university archive and personal profile.
Chapter V Supplementary Provisions
Article 39 The terms “or above” or “from…to…” referred to in these Provisions includes the level of disciplinary action; “less than “does not include the level.
Article 40 These regulations shall be taken into effect since the day of release and be interpreted by School of International Education and the Student Affairs Office.
